Mr. Conner called the meeting to order and explained procedures for the evening.  

CASE NO. 3455 – SCOTT B. RICHARDS – LONG POND ROAD

Sitting: Peter Conner, Michael Main, Robert Richard, William Keohan, and David Peck.

Mr. Richard read the legal advertisement into the record.

Mr. Richards, the petitioner, referred to the letter submitted with the petition.  The cabin sits in the same footprint as the original camp.

CASE NO. 3456 – BROOKE and GEORGE NIELSEN – SANDWICH STREET

Mr. Richard read the legal advertisement into the record.

Mr. Nielsen said that the dwelling was over 300 years old.  The existing garage had a tree fall through it during the Patriot’s last storm.  The proposed garage will look like the existing dwelling.

CASE NO. 3439 – SECURED REALTY INC. – STATE ROAD – Continued from 9/12/07.  

Sitting: Peter Conner, William Keohan, David Peck, Robert Richard, and Marc Betti.

Attorney Angley, representing the petitioner, referred to a written presentation on file in the ZBA office.  The correct side of the proposed retail center is 14,000-sq. ft.

Mr. Shaw, Associated Engineering, reviewed the site.

Mr. Henson, Landscape Architect, reviewed the landscaping, buffers, and island details.

Attorney Angley said that Sid Kashi would like the developer to design the signalization at Herring Pond Road and 3A.  The petitioner has agreed to do so.

Mr. Müller said that the conditions in this area (level F) are the same as it was when the Stop & Shop was proposed.  The area is failing with or without this project.

Mr. Kashi, Town Engineer, spoke about the traffic lights.

CASE NO. 3455 – SCOTT B. RICHARDS – LONG POND ROAD

Mr. Main made a motion to approve with condition that the dwelling not be turned into a year-round dwelling.

Mr. Richard seconded.

4-1 Granted.

CASE NO. 3456 – BROOKE and GEORGE NIELSEN – SANDWICH STREET

Mr. Peck made a motion to approve.

Mr. Betti seconded.

3-2 – Mr. Conner and Mr. Richard opposed.

Denied.

INFORMAL MATTER

CASE NO. 3432 – WOOD BUILDERS DEVELOPMENT – LITTLE SANDY POND ROAD

Mr. Lucy, Land Management Systems, said that the petitioner would like to have Conditions 2, 8, & 9 accepted as complete.

Mr. Richard made a motion to accept Conditions 2, 8, and 9 as completed.

Mr. Main seconded.

Unanimously accepted.

No further business came before the Board.
